Scrapping a car without the title
Can I scrap a car in Illinois without the title?
Sometimes. Illinois law requires a scrap buyer like Cash for Scrap Junk Cars to collect proof of ownership and to record two forms of ID from the seller. The title is the usual proof, but the law lists others. Tell us what papers you have, such as a registration card, and we'll confirm on the call which route fits your car.
The form on this page asks one paperwork question: do you have the title? There’s an option for “I have registration only” because that answer comes up often. Here’s why it matters, and what Illinois actually says.
What the law requires from a scrap buyer
Illinois puts the rule on the buyer. Under 625 ILCS 5/5-401.3, when a scrap processor buys a vehicle from a private person, it has to record that person’s identity from at least two sources of identification, one of them a driver’s license or a state ID card. It also has to collect documentary proof of ownership in one of these forms:
- a Certificate of Title
- a Salvage Certificate
- a Junking Certificate
- a Secretary of State Junking Manifest
- a Certificate of Purchase
- or “other similar documentary proof of ownership”
The statute then says the buyer “shall not acquire” the vehicle without one of them, and failing to keep that proof for three years is a Class A misdemeanor. So a buyer who promises the title doesn’t matter is either relying on another document from that list or cutting a corner you’ll share in.
If the title is lost
The cleanest fix is a duplicate. The Illinois Secretary of State issues one when the original is lost, stolen or damaged. You file form VSD 190 (Application for Vehicle Transaction(s)), check the duplicate title box and pay $50. If a lender is still listed, you’ll also need proof the loan is paid off, such as a lien release letter.
The scrap paperwork guide has a table of common situations: title in hand, title lost, title with a lien, registration only, and a car that belonged to someone else.
Registration only
A registration card shows the car was registered to you. Whether it works as “similar documentary proof” for your particular car is something we confirm on the call rather than promise on a web page. Have it ready, along with your driver’s license or state ID and a second form of ID.
Things that don’t work
- A form meant for insurers. VSD 929, the affidavit in lieu of title for a salvage or junk vehicle, is only for insurers under the Illinois Insurance Code who have paid a total-loss claim.
- Someone else’s signature. If the title is in another person’s name, that person (or whoever has legal authority for them) has to be part of the sale.
- A car with a tampered VIN. Illinois recyclers are required to refuse a vehicle whose identification number looks altered and to notify police.
Once the papers are settled, the pickup works like any other scrap car removal. Afterward, the after-the-sale checklist covers plates and the Seller’s Report of Sale.
Questions we get
- Is a bill of sale enough to scrap a car in Illinois?
- Don't count on it. A bill of sale is not on the statute's list of ownership documents for a scrap sale. Let us know which papers you hold, and we'll check them with you by phone.
- How do I get a duplicate title?
- File the Application for Vehicle Transaction(s), form VSD 190, with the Illinois Secretary of State and check the duplicate title box. The fee is $50. The title has to be lost, stolen or damaged to qualify.
- What if there's still a lien on the title?
- The lien has to be cleared first. The Secretary of State accepts a lien release letter from the lender, among other proofs, when you apply for a clean title.
- The car belonged to a relative who died. Can I sell it?
- Possibly, but who can sign depends on the estate. Call us with what paperwork you have, and check with the Secretary of State or the estate's attorney before the pickup.
